      Implementation Measures for Cultivating and Supporting the Leading Agricultural Enterprises of Zengcheng District

        Article 1 In order to further support the leading agricultural enterprises of the District to become bigger and stronger, and improve the market competitiveness of leading agricultural enterprises of the District, subject to the requirements of the Opinions of the General Office of the People’s Government of Guangdong Province on Further Supporting the Accelerated Development of Leading Agricultural Enterprises (Yue Fu Ban [2016] No. 136), the Notice of the Bureau of Agriculture and Rural Affairs of Guangzhou Municipality and the Guangzhou Municipal Finance Bureau on Printing and Distributing the Implementation Scheme for Urban Modern Agricultural Rewards of Guangzhou from 2017 to 2020 (Sui Nong Han [2020] No. 32), the Notice of Bureau of Agriculture and Rural Affairs of Guangzhou Municipality on Printing and Distributing the Measures for Management of Identification and Operation Supervision of Leading Agricultural Enterprises of Guangzhou Municipality (Sui Nong Gui Zi [2020] No. 2), as well as the actualities of the District, the Implementation Measures is hereby formulated.

        Article 2 The leading agricultural enterprises in the Measures include the leading agricultural enterprises of the State, Guangdong Province, Guangzhou and Zengcheng District, which are agricultural enterprises recognized by relevant superior departments and the People’s Government of Zengcheng District.

        Article 3 The state-level, provincial-level and municipal-level leading agricultural enterprises undergo the identification and supervision management by the corresponding central, provincial-level and municipal-level departments of agriculture and rural affairs respectively.

        Article 4 The district-level leading agricultural enterprises refer to the enterprises which are registered in the administrative region of Zengcheng District, take the agricultural product production, processing and circulation, seed industry, sightseeing and leisure agriculture, agricultural science and technology service, special culture and other agriculture related industries as the main business, meet the specified standard in such aspects as enterprise scale, product quality safety, radiation driving force and competitiveness, and are recognized by the People’s Government of Zengcheng District.

        Article 5 The identification and operation supervision of district-level leading agricultural enterprises are carried out based on the open, fair, just and “survival of the fitness” principles.

        Article 6 The Bureau of Agriculture and Rural Affairs of the District organizes the declaration and identification of district-level leading agricultural enterprises and the supervision and verification of their operation.

        Article 7 An enterprise which declares itself as a district-level leading agricultural enterprise must meet the following conditions.

        7.1 It is registered in the District and an independent legal entity;

        7.2 Its tax collection and management relationship and statistical relationship are within the scope of Zengcheng District;

        7.3 It takes the agricultural product production, processing and circulation, seed industry, sightseeing and leisure agriculture, agricultural science and technology service, special culture and other agriculture related industries as its main business, and its agriculture related business revenues account for 51% or above of total revenues;

        7.4 It has a certain scale and strong driving forces and competitiveness;

        7.5 It has good operating conditions and credit conditions and are not in the integrated punishment state due to dishonest behavior.

        Article 8 If an enterprise has any of the following behaviors, it shall be deprived of the identification qualification of district-level leading agricultural enterprises. If it has obtained the qualification, it shall be disqualified.

        8.1 It practices fraud and provides false information;

        8.2 It suffered from the administrative punishment due to doing harm to the farmer in the past year;

        8.3 Awork safety accident of farm machinery occurred in the past year;

        8.4 It suffered from the punishment by the administrative department due to the illegal production of disqualified agricultural products in the local production in the past three years; its responsible person was prosecuted for criminal liability due to the illegal production of disqualified agricultural products in the local production in the past four years;

        8.5 It was investigated for defrauding financial funds in the past five years;

        8.6 It fails to cooperate with the daily supervision by the administrative department of agriculture and rural affairs of the District, and to submit the data within the time limit;

        8.7 It is involved in other circumstances under which the district-level leading agricultural enterprise qualification is cancelled.

        The periods specified in (2)-(6) of this article are calculated from the date of issuance of the Notice on identification of district-level leading agricultural enterprises in that year.

        Article 9 According to the main business characteristics, the district-level leading agricultural enterprises are divided into 5 types: agricultural product production enterprise, agricultural product processing and circulation enterprise, agricultural product market driving enterprise, agricultural science and technology service enterprise, and other agriculture related industry enterprise. In such aspects as proportion of agriculture related business revenues, scale, credit, driving force and competitiveness of the enterprises, the enterprises are listed as the candidate enterprises when the comprehensive score are more than 80 points (included). (Refer to Attached Table 1 and Attached Table 2 for the classification standard and scoring standard)

        Article 10 An enterprise to declare itself as a district-level leading agricultural enterprises shall truthfully provide the following materials:

        10.1 Guangzhou Zengcheng District Leading Agricultural Enterprises Declaration Form (Attached Table 3);

        10.2 Its financial audit report of the previous year issued by a qualified accounting firm;

        10.3 Copy of property right certificate of production base, or land and production facility lease contract, agreement, or investment cooperation certificate signed by the enterprise;

        10.4 Contacts (agreements) signed for agricultural product purchase and sales, order-based agriculture, benefit-sharing compensation, profit return, lease and other with the farmer, farmers’ cooperative, family farm, specialized farmer and the like, farmers-driven register (name, address and telephone number), relevant financial certificate and other materials;

        10.5 Register of farm (fishery) workers recruited by the enterprise, and materials about participation in the social insurance for employees (the certificate of payment of social insurance for employees by it and the payroll indicating the withholding of social insurance for employees);

        10.6 Product quality certificate, environmental protection certificate, high-tech enterprise certificate, scientific and technological achievement, trademark, patent and other materials;

        10.7Explanations about whether it was investigated for defrauding financial funds in the past five years;

        10.8 Ledger of agricultural inputs purchased and received, ledger of agricultural inputs used, ledger of agricultural products produced, ledger of quality and safety test of agricultural products, and ledger of agricultural products sold;

        10.9 Other materials required.

        Article 11 Declaration and identification procedures of district-level leading agricultural enterprises

        11.1Declaration.

        An enterprise shall directly make an application to the administrative department of agriculture and rural affairs in the town and sub-district where it is located.

        11.2 Verification.

        11.2.1. The administrative department of agriculture and rural affairs of the towns and sub-districts conducts the initial verification on the materials provided by enterprises, solicits the opinions from the development and reform, tax, market supervision, human resources and social security, planning and natural resources, ecological environment and other departments of the District, and officially recommends in written form the qualified enterprises to the administrative department of agriculture and rural affairs of the District in the name of town and sub-district.

        11.2.2. The administrative department of agriculture and rural affairs of the District entrusts an intermediary organ to verify the declaration materials of the enterprises and to give points and deliver the verification opinions according to the classification standard and scoring standard.

        11.3 Identification

        11.3.1. After the comprehensive consideration of verification opinions and scoring results delivered by the intermediary organ, the administrative department of agriculture and rural affairs of the District formulates the list of to-be-identified district-level leading agricultural enterprises.

        11.3.2. The list of to-be-identified enterprises is publicized for 7 days. If there is no objection, it is submitted to the People’s Government of the District for identification; if there is any objection, the administrative department of agriculture and rural affairs of the District conducts a further verification, after which, enterprises meet the conditions for district-level leading agricultural enterprises will be reported to the People’s Government of the District for identification, and those do not meet will be disqualified for identification.

        11.3.3. The administrative department of agriculture and rural affairs of the District confers the “Guangzhou Zengcheng District Leading Agricultural Enterprise” title to enterprises identified by the People’s Government of the District, issues them a plaque and makes an announcement to the public. 

        Article 12 The “Guangzhou Zengcheng District Leading Agricultural Enterprise” qualification granted upon approval from the People’s Government of the District will be valid for three years after the date of identification. Enterprises fail to be re-identified before the valid term expires will be disqualified for “Guangzhou Zengcheng District Leading Agricultural Enterprise”.

        Article 13 We support the financing of the leading agricultural enterprises and reduce their financing costs. The Finance Department of the District annually arranges a special fund of RMB 10 million to subsidize the leading agricultural enterprises that do not enjoy the interest subsidy from the superior governmental departments according to the benchmark interest rate of the People’s Bank of China for the same period with regard to interest of bank loans arising from technical transformation of agricultural product processing, agricultural industrial base construction, corporate production scale expansion and other needs. The total amount of interest subsidy of each enterprise does not exceed RMB 1 million.

        Article 14 New identified state-level, provincial-level, municipal-level and district-level leading agricultural enterprises will be granted with RMB 1 million, RMB 500,000, RMB 200,000 and RMB 100,000 rewards respectively in a one-off manner and will enjoy the preferential supporting policies at all levels accordingly.

        Article 15 Leading agricultural enterprises which are conferred the famous brand product (agriculture) title at state-level, provincial-level, municipal-level will be granted with RMB 500,000, RMB 200,000 and RMB 100,000 rewards respectively in a one-off manner.

        Article 16 We support leading agricultural enterprises to carry out the research and development of new agricultural varieties and technologies. Leading agricultural enterprises which pass the accreditation at the state or provincial-level on a new variety and are conferred the accreditation certificate will be granted with RMB 500,000 and RMB 200,000 rewards respectively.

        Article 17 Enterprises which are conferred the science and technology award at the state or provincial level will be granted with 1:1 fund rewards respectively, subject to the maximum of RMB 5 million for the same project.

        Article 18 Science and technology projects of leading agricultural enterprises which are given the project approval subsidy from the science and technology department of the State, Province and Municipality will be granted with the supporting rewards by means of “post-subsidy”; As  state-level science and technology projects will be granted with 100% fund support, subject to the maximum of RMB 5 million; provincial-level science and technology projects will be granted with 70% fund support, subject to the maximum of RMB 3 million; municipal-level science and technology projects will be granted with 50% fund support, subject to the maximum of RMB 1 million. In principle, the maximum amount of district-level science and technology project support subsidy granted to each leading agricultural enterprise each year shall not exceed RMB 5 million; the maximum amount of financial subsidy of the superior governmental departments and that of the District granted to a single project should not exceed the total amount of self-raised funds of project undertaker and the excess will not be given support.

        Article 19 Processing projects of leading agricultural enterprises which do not enjoy the supporting policy will be granted with the financial subsidy in proportion to no more than 45% of total project investment, subject to the maximum of RMB 1 million for each leading agricultural enterprise.

        Article 20 We encourage and support leading agricultural enterprises to positively transfer the land for expanding the production scale. Leading agricultural enterprises which meet the subsidy conditions will be granted the Finance Department of the District with the rewards as per RMB 500/mu.

        Article 21 The supervision information statistical system shall be established. The district-level leading agricultural enterprises shall report the monthly, quarterly and annual operations as required.

        Article 22 The administrative department of agriculture and rural affairs of the District organizes the operation supervision of district-level leading agricultural enterprises according to the standards set forth in Article 7, Article 8 and Article 9 of the Measures. The specific procedure, time, object and material requirements are subject to the Notice of the administrative department of agriculture and rural affairs of the District. The supervision results will be announced after they are reported by the administrative department of agriculture and rural affairs of the District to the People’s Government of the District for confirmation.

        If an enterprise is qualifiedupon being monitored, it will continuously be qualified as a district-level leading agricultural enterprise; if it is not, it will be disqualified.

        Article 23 If a district-level leading agricultural enterprise’s name, legal representative, registered address and other important information are changed, it must submit a written report to the administrative department of agriculture and rural affairs of town (sub-district) and the administrative department of agriculture and rural affairs of the District together with relevant change materials. If the information change leaves no effect on the identification elements of the leading agricultural enterprise, the enterprise will continuously be qualified as a district-level leading agricultural enterprise.

        Article 24 In the support contents, other policies of the same kind of the District are not repeatedly enjoyed. If the same supported object involves other supports of the same kind in Zengcheng District, the support will be implemented subject to “adopting the higher one with no repetition” principle, unless otherwise specified.

        Article 25 The Measures shall take effect as of the date of issuance with a valid term of three years. The specific support contents involved shall be subject to the declaration guidelines issued every year. The Measures of Guangzhou Zengcheng for Management of Identification and Operation Supervision of Agricultural Leading Enterprises(Zeng Nong Zi [2015] No. 9) shall be annulled simultaneously.

      5. Other agriculture related industry

      Enterprises which engage in the advanced farm machinery, pesticide (veterinary drug), feed and fertilizer production; special aquaculture such as ornamental fish; slaughtering service, sightseeing and leisure agriculture, internet+ agriculture and other new agricultural types of businesses.

      2.1. Total assets

      If they reach RMB 5 million or above, 4 points are given. For every decrease of RMB 500,000, 1 point is deducted. For every increase of RMB 1 million, 1 point is given, subject to the maximum of 4 additional points.

      If they reach RMB 10 million, 4 points are given. For every decrease of RMB 1 million, 1 point is deducted. For every increase of RMB 2 million, 1 point is given, subject to the maximum of 4 additional points.

      If they reach RMB 20 million, 4 points are given. For every decrease of RMB 2 million, 1 point is deducted. For every increase of RMB 3 million, 1 point is given, subject to the maximum of 4 additional points.

      If they reach RMB 2 million, 4 points are given. For every decrease of RMB 100,000, 1 point is deducted. For every increase of RMB 500,000, 1 point is given, subject to the maximum of 4 additional points.

      If they reach RMB 5 million (wherein:farm machinery, pesticide (veterinary drug), feed and fertilizer and other production and slaughtering services reach RMB 10 million), 4 points are given.       2.2. Fixed assets

      If they reach RMB 2 million, 3 points are given. For every decrease of RMB 100,000, 1 point is deducted. For every increase of RMB 200,000, 1 point is given, subject to the maximum of 3 additional points.

      If they reach RMB 3 million, 3 points are given. For every decrease of RMB 200,000, 1 point is deducted. For every increase of RMB 300,000, 1 point is given, subject to the maximum of 3 additional points.

      If they reach RMB 10 million, 3 points are given. For every decrease of RMB 2 million, 1 point is deducted. For every increase of RMB 3 million, 1 point is given, subject to the maximum of 3 additional points.

      If they reach RMB 1 million, 3 points are given. For every decrease of RMB 100,000, 1 point is deducted. For every increase of RMB 200,000, 1 point is given, subject to the maximum of 3 additional points.

      If they reach RMB 10 million, 23 points are given. For every decrease of RMB 300,000, 1 point is deducted. For every increase of RMB 2 million, 1 point is given, subject to the maximum of 3 additional points.

      If they reach RMB 300 million, 23 points are given. For every decrease of RMB 5 million, 1 point is deducted. For every increase of RMB 30 million, 1 point is given, subject to the maximum of 3 additional points.

      If they reach RMB 5 million, 23 points are given. For every decrease of RMB 200,000, 1 point is deducted. For every increase of RMB 500,000, 1 point is given, subject to the maximum of 3 additional points.

      If they reach RMB 4 million (wherein: farm machinery, pesticide (veterinary drug), feed and fertilizer and other production and slaughtering services reach RMB 20 million), 23 points are given. For every decrease of RMB 100,000 (wherein, for every decrease of RMB 500,000 of farm machinery, pesticide (veterinary drug), feed and fertilizer and other production and slaughtering services), 1 point is deducted.       3. Enterprise credit

      3.1. Tax payment

      In an audit year of an enterprise, if the taxes are paid according to the law, 5 points are given. If the enterprise has been subjected to the tax punishment due to the tax audit or has tax in arrears, 0 point is given.

      3.2. Labor employment management

      In an audit year of an enterprise, if the enterprise has not been subjected to the administrative punishment arising from the violation of the labor security laws, regulations and rules, 5 points are given. If the enterprise has been subjected to such administrative punishment, 5 points are deducted.

      3.3. Bank credit

      In the daily economic transactions, if an enterprise obeys the law, is honest and operates normally, 5 points are given. If the enterprise has bad credit records in a financial institution, 2 points are deducted.

      4. Driving force

      If an enterprise involves 40 tightly driven farmers (including farmers’ cooperative and family farm of equivalent scale) or 100 loosely driven farmers, 10 points are given. If it does not, 0 point is given.

      5. Competitiveness

      Additional points are given if the following conditions are met, subject to the maximum of 30 points:

      1. If the production base of an enterprise is listed as the production base of “vegetable basket” in Guangdong-Hong Kong-Macao Greater Bay Area, 20 points are given.

      2. If an enterprise is recognized as the standard demonstration site of livestock and poultry cultivation, demonstration site of healthy aquaculture or standard vegetable (fruit) garden by the Ministry of Agriculture and Rural Affairs, 10 points are given.

      3. If an agricultural scientific and technological achievement award, scientific and technological promotion award or high-tech enterprise qualification at the city level or above is conferred, 10 points are given.

      4. If an enterprise is a cultivation, breeding and promotion integration enterprise, backbone enterprise in China’s seed industry, Class A credit enterprise in the seed industry or state-level seed multiplication farm, or it is identified (or recognized) as a seed industry platform enterprise at the city level or above, 10 points are given for each item.

      5. If an enterprise is conferred the honorary title of a demonstration site of leisure agriculture and rural tourism, demonstration garden of sightseeing and leisure agriculture and agricultural park at the city level or above, and is recognized as 3A or above tourist attraction, 10 points are given for each item.

      6. If an enterprise is identified as a provincial-level seed multiplication farm, stock livestock and poultry site or progenitor breeding poultry site, 8 points are given. If the enterprise is identified as a city-level seed multiplication farm, parent breeding poultry site or breeding stock expanding propagation site, 5 points are given. If the enterprise is conferred the crop seed operation (production and operation) license, 5 points are given.

      7. If an enterprise is conferred the famous (well-known) trademark certificate, provincial famous brand product certificate, vegetable basket base certificate of Guangdong Province, organic food certificate, green food certificate, nuisanceless certificate, certificate of origin of agricultural products or certificate of product with geographical indication, 8 points are given for each time; if the enterprise is identified as a standard agricultural demonstration area at the city level or above, 5 points are given.

      8. If an enterprise has the right of the new variety plant, more than 1 product conferred the state-level award, the commodity output value of more than RMB 5 million, or the proportion in the national market share of such variety of more than 1%, 7 points are given for each item.

      9. If a fishery culture enterprise has completed the pond culture water treatment of Guangzhou and meets the water quality requirements, 3 points are given.

      10. In the past one year, if a grain, vegetable or fruit planting enterprise has applied for the commodity organic fertilizer subsidy, 3 points are given.

      11. If the production can be carried out according to or exceeding the national standard, industrial standard, and local standard, 2 points are given.

      12. If an agricultural product processing enterprise has the processing base or production facility that meets the national environmental protection standard or food processing health standard, 5 points are given for each item. If two items are met, 10 points are given.

      13. If an agricultural product circulation enterprise or a market driving enterprise has the transaction site or agricultural product transportation (storage) facility that meet the national environmental protection requirements, 5 points are given for each item. If two items are met, 10 points are given.

      14. If the rate of return on total assets is not lower than the benchmark interest rate for one-year bank loan of financial institution, 5 points are given.

      15. If an enterprise has a certificate of patent for invention or a trademark registration certificate, 5 points are given for each item.

      16. If a enterprise has a corporate management system and a financial system, and passes the corporate management system certification or occupational safety and health management system certification, 4 points are given for each item.

      17. If an enterprise is recognized as an integrity enterprise of environmental protection/good enterprise of environmental protection or a trustworthy enterprise, 3 points are given for each item.

        Remarks:

        1. The audit year in the Measures is calculated from a year before the date of issuance of the Notice on identification of district-level leading agricultural enterprise in that year.

        2. Tightly driven farmers in the Measures refer to the farmers driven by absorption employment, order-based acquisition, farmland lease and farm house lease, with the details subject to the order, contract and payroll accounting voucher. Loosely driven farmers refer to those driven by acquisition of agricultural products, implementation of technical training, provision of technical service, provision of operating site, product or service radiation, with the details subject to the contract, accounting voucher, training record and ledger. Tightly driven farmers and loosely driven farmers may be converted as per 1:5. If one item is met or the sum after conversion meets one item, it is qualified.

        3. If relevant certificate authentication and title assessment of an enterprise have been completed, but the publicity or approval has not been done, it is identified in principle.

        4. As for a composite enterprise, its type of enterprise is determined based on its industry category with the largest proportion, and its scoring items will be given points based on the actualities of the enterprise. If the industry category with the largest proportion fails to meet the declaration requirements, and the industry with the second largest proportion exceeds more than 60% of annual sales revenues or turnover standard set forth in the identification standard of the corresponding category of the enterprise, the type of enterprise may be determined based on the industry category with the second largest proportion, and the scoring items will be given points based on the actualities of the enterprise.

        5. The “total assets”, “fixed assets” and “annual sales (operating) revenues or transaction amount” in the Measures are not subject to the point deduction method.
