        Measures for the Administration of Investment Promotion Support Funds in Zengcheng District

        Chapter I General Provisions

        Article 1 In order to regulate the use and management of support funds for investment promotion, make more efforts to attract investment, innovate the mode of capital introduction, improve the quality and level of investment promotion, theseMeasures are formulated according to in accordance with relevant laws and regulations such as the Budget Law of the People's Republic of China, Measures for the Administration of Special Funds for Guangzhou Municipal Finance (Sui Fu Ban Han [2020] No.12),  Notice of the General Office of Guangzhou Municipal People's Government on Issuing Measures for the Administration of Funds for Industrial Development in Guangzhou (Sui Fu Ban Gui [2018] No.3) and the Measures for Promoting Enterprises to Accelerate Settlement in Guangzhou (Trial) (Sui Fu Ban Gui [2018] No.16).

        Article 2 Support funds for investment promotion and capital introduction in Zengcheng District (hereinafter referred to as " support funds for investment promotion ") refer to the financial funds arranged by the district level to promote investment promotion and capital introduction in Zengcheng district.

        Article 3 The use and management of support funds for investment promotion shall follow the principles of legal establishment, standardized management, strict examination and approval, clear powers and responsibilities, scientific argumentation, performance priority, openness and fairness, and strengthened supervision.

        Article 4 TheDistrict Bureau of Science and Technology, Industry, Commerce and Information, Zengcheng Economic and Technological Development Zone Trade and Technology Information Bureau, the District Education Bureau, the District Civil Affairs Bureau, the District Agriculture and Rural Bureau, the District Bureau of Culture, Radio, Film, Tourism and Sports, the District Bureau of Health, the District Bureau of Finance, the Development and Reform Finance Bureau of the Economic and Technological Development Zone, the District Bureau of Audit and the towns and streets offices shall jointly do a good job in the management and supervision of support funds for investment promotion according to the division of responsibilities.

        (a) The District Bureau of Science and Technology, Industry, Commerce and Information is responsible for the establishment and adjustment of funds, takes the lead in the formulation of specific management measures and annual plans for the use of the support funds, coordinates and controls the scale of the funds, promotes the integration of financial funds, and coordinates the matters to be solved put for forward by various competent business departments.

        (b) The District Bureau of Science and Technology, Industry, Commerce and Information, Zengcheng Economic and Technological Development Zone Trade and Technology Information Bureau, the District Education Bureau, the District Civil Affairs Bureau, the District Agriculture and Rural Bureau, the District Bureau of Culture, Radio, Film, Tourism and Sports, the District Bureau of Health, the District Bureau of Finance are responsible for the budget application of specific objects of support funds for investment promotion in their respective fields, and prepare plans for the allocation and use of funds, take charge of project application, review, approval, information disclosure, supervision, inspection and project performance evaluation, etc. The working funds required for project application and review shall be uniformly allocated from the support fund for investment promotion of each organization.

        (c) The District Bureau of Finance and the Development and Reform Finance Bureau of the Economic and Technological Development Zone are responsible for the budget arrangement, plan announcement and allocation of funds, and carry out performance evaluation and daily monitoring of project funds.

        (d) Relevant departments of the Development Zone, towns and streets cooperate with the District Bureau of Science and Technology, Industry, Commerce and Information, the District Education Bureau, the District Civil Affairs Bureau, the District Agriculture and Rural Bureau, the District Bureau of Culture, Radio, Film, Tourism and Sports, and the District Bureau of Health, to take charge of the project application, examination, supervision, inspection, and performance evaluation of the funds of enterprises and organization under their respective jurisdictions.

        (e) The district audit department, in accordance with the law and in the principle of "whoever is in charge has the right to examine; whoever uses is responsible", implements audit supervision on the management, allocation and use of funds, and shall submit an audit result report to the district government; According to regulations, clues of cases of violation of law and discipline found in the audit will be handed over to discipline inspection and supervision organs.

        Article 5 The performance objectives of support funds for investment promotion are: to attract domestic and foreign enterprises to invest in Zengcheng and to accelerate the settlement of newly introduced projects; Promote local enterprises to increase capital and expand production thus getting better and stronger; To improve the attraction and competitiveness of industrial parks and commercial buildings for potential projects; Promote social intermediary organizations to participate in investment promotion and capital introduction.

        Chapter II Direction for Support and Mode for Allocation

        Article 6 The scope of support funds for investment promotion shall conform to the macro-control policies and industrial development orientation of the state, province, city and Zengcheng district, focusing on the development strategy of "strong industrial district", and in line with the major decisions and arrangements of the district party Committee and government on investment promotion as well as the key investment promotion direction of Zengcheng district.

        Article 7 Support funds for investment promotion are mainly used for the following directions:

        (a) Encourage the introduction of major projects. It will be used to support major projects in advanced manufacturing, modern service and modern agriculture to speed up the settlement and operation (or operation) so as to promote the development of advanced manufacturing, modern service and modern agriculture in Zengcheng district.

        (b) Encourage social capital to invest in profitable public welfare projects. It is used to support social capital to invest in libraries, cultural centers (group art centers), academies, museums, art galleries, exhibition halls, theaters and other public welfare cultural facilities to spread Chinese culture to the public; set up various medical institutions of traditional Chinese and Western medicine; establish various modes of nursing homes, nursing facilities for the elderly, apartments for the elderly, nurseries for the elderly, community service centers for the elderly, comprehensive welfare homes and other civil affairs service institutions; facilitate basic education, vocational education, higher education and other public welfare projects concerning education.

        (c) Encourage enterprises to increase capital and production. It is used to support enterprises settled in the district to increase capital, expand production and operation, and help enterprises to get better and stronger.

        (d) Strengthen the construction of investment promotion carriers. It is used to support social capital to participate in investment in new buildings or upgrade and transform old commercial buildings, factories and other resources into high-quality investment promotion carriers, and to support the investment promotion carriers in attracting investment.

        (e) Encourage social intermediaries to participate in investment promotion. It is used to support social intermediaries to introduce industrial projects invested by funds outside the district to Zengcheng district, and to hold various investment promotion activities through public selection and signing investment promotion cooperation agreements.

        (f) Encourage departments, town and streets to carry out investment promotion work. It is used to support towns and streets to actively introduce major projects and to support departments, towns and streets to share information about investment promotion.

        (g) The district party Committee and the district government can adopt the "one thing, one discussion" approach for major investment promotion projects that in clear need for support.

        Article 8 Support funds for investment promotion are mainly allocated by project method. The allocation of funds for projects is mainly to determine specific support projects and allocate funds by means of subsidies, incentives, discount interest, post-subsidy, equity investment, guiding funds, risk compensation, competitive negotiation, bidding, pre-allocation before liquidation, etc.

        Article 9 A "List of Major Projects + Supporting Items" mechanism shall be established. According to the support direction of Article 7 of these Measures, support funds for investment promotion are led and coordinated by theDistrict Bureau of Science and Technology, Industry, Commerce and Information. According to the medium and long-term development plans, annual work priorities and budget arrangements for industry, commerce, information technology, science and technology, education, culture, tourism, health, agriculture and other factors, specific support items are determined, and sub-items are set up for management under the support funds for investment promotion in Zengcheng District, Guangzhou. In principle, the support fund for investment attraction managed by a competent business department should be no more than one type, and development funds of the same nature are generally managed by the same department. Industries or fields supported by funds should be diverse and avoid overlapping.

        If there’s need to adjust the scope of use or usage of support funds for investment promotion, set up or change support items, increase or decrease budget arrangements, the application should be filed by theDistrict Bureau of Science and Technology, Industry, Commerce and Information in conjunction with the competent departments of the business to the District Bureau of Finance and report to the district government for approval.

        Article 10 TheDistrict Bureau of Science and Technology, Industry, Commerce and Information, Zengcheng Economic and Technological Development Zone Trade and Technology Information Bureau, the District Education Bureau, the District Civil Affairs Bureau, the District Agriculture and Rural Bureau, the District Bureau of Culture, Radio, Film, Tourism and Sports, the District Bureau of Health shall formulate corresponding implementation rules for the supporting matters of support funds for investment promotion in their respective fields. They shall make clear fund performance objectives, scope of use, management responsibilities, allocation mode and methods, supervision and evaluation and accountability, etc.

        If the supporting matters are temporary or specific work tasks, each organization shall formulate an allocation plan and submit it to the district government for examination and approval before implementation.

        Chapter III Project Management

        Article 11 Before project application every time, theDistrict Bureau of Science and Technology, Industry, Commerce and Information, Zengcheng Economic and Technological Development Zone Trade and Technology Information Bureau, the District Education Bureau, the District Civil Affairs Bureau, the District Agriculture and Rural Bureau, the District Bureau of Culture, Radio, Film, Tourism and Sports, the District Bureau of Health shall issue application guidelines (or notices) for specific supporting matters in their respective fields. They shall made clear application object, scope of use of funds, application conditions, application procedures and requirements, contact information, etc.

        Eligible organizations (hereinafter referred to as "applicants") can apply for support fund for investment promotion in accordance with relevant regulations and application guidelines (notices).

        Article 12 An applicant shall meet the following basic conditions:

        (a) Enterprises and institutions, social organizations or other organizations or individuals that meet the requirements registered in accordance with the law.

        (b) According to the regulations of the credit management department, it has not been included in the "blacklist of joint disciplinary actions against dishonesty".

        (c) Other conditions that should be met according to regulations.

        Article 13 The items applied by the applicant shall meet the following basic requirements:

        (a) The support object, scope of use, application conditions, etc., shall be in accordance with the provisions of the fund management measures and the detailed rules for the implementation, as well as the application guidelines. The application of funds cross the scope shall not be accepted.

        (b) The projects, planned tasks and implementation plans supported prior to and during the process are feasible, and the project performance objectives are clear, scientific and reasonable.

        (c) If the same project or enterprise and the same matter conform to other supporting policies and regulations in Zengcheng district (including the policies and regulations that the higher authorities require the district to support or undertake funds), they shall be supported in principle in accordance with the highest standard instead of repeated rewards, except as otherwise provided.

        (d) The application materials for the project must be true, accurate and complete, and the applicant shall not resort to deceit, arbitrage or defraud financial funds.

        Article 14 The applied items shall be reviewed according to the following procedures:

        (a) Issuing the notice for application. In March of each year, the application notice will be publicly issued on the Zengcheng District Government portal website, which will be simultaneously issued to enterprises by the local economic management department.

        (b) Project audit. In April of each year, the leading organization for specific fund support matters reviews the application files of the enterprise. If the application files do not meet the requirements, they will not be accepted and will be informed of the reasons for rejection. If the information is incomplete, the applicant will be informed to complete the information at one time.

        (c) Project review. In May of each year, each leading organization reviews the project application files through intermediary organizations, organized experts or internal reviews, and conduct on-site verification when necessary. In the process of project review, the applicant's subject qualification and the project should be reviewed through the implementation of the detailed rules for granting support funds.

        Article 15 Each leading organization shall complete the review and determine the projects to be supported before May 30 each year. In addition to matters requiring confidentiality, each organization will publicize the projects to be supported after the review to the public for 7 working days on Zengcheng District Government portal website. If there’s any objection to the publicized projects, each leading organization shall give the correspond opinions.

        Article 16 Support funds for investment promotion shall be fully managed through the project library. For projects that have been reviewed and publicized without objection and have passed the examination and approval, each leading organization shall prepare specific project plans according to the amount of funds used in the current year and priorities, submit them to the District Bureau of Finance together with the annual department budget, and incorporate them into the management of the department project library and the financial project library according to regulations.

        Article 17 For support funds for investment promotion that have not been detailed for specific projects to be supported in the preparation of departmental budgets, each competent department shall, within 60 days from the date of financial approval of the departmental budget, formulate a fund allocation plan and report it to the district leaders in charge for approval, file it with the District Bureau of Finance, and make clear the specific organizations according to the approved allocation plan before June 30 of that year.

        Article 18 The DistrictBureau of Finance shall timely issue the fund budget for the funds approved for use in accordance with the regulations, and each leading organization shall timely proceed with the fund allocation procedures in accordance with the relevant provisions on centralized treasury payment.

        Article 19 After using the support funds for investment promotion, the project implementation subject shall timely make financial accounts on the use of project funds.

        If the project acceptance shall be carried out according to the requirements,after the completion of the project, the project implementation subject shall promptly submit an acceptance application to the project competent department clearly specified in the implementation rules for various supporting matters or application guidelines (or the department responsible for fund arrangement and allocation if not clear). The project competent department shall take the lead in organizing the party that used the funds to carry out project acceptance and check the use of funds.

        Article 20 Project implement subject shall strictly implement relevant financial rules and regulations and accounting methods. All expenditures must be strictly controlled within the approved scope and expenditure standards. The system of writing off bills for the use of financial funds must be strictly implemented. It is strictly prohibited to use "blank-titled bills" to enter accounts or cash out.

        Article 21 If the project needs to be changed or canceled due to changes in objective conditions during the implementation process or other factors, the project implementation subject shall submit an application for change or cancellation to the competent department of the project, andafter review, the competent department shall report to the leading organization for specific fund support matters for approval.

        For projects that change the investment amount or cancel it for some reason, the project implementing subject shall settle the funds and return the surplus funds to theDistrict Bureau of Finance through the original allocation channel after being examined and approved by the project competent department and the leading organization for specific fund support matters.

        Chapter IV Supervision,Administration and Accountability

        Article 22 Except thatthere’s confidentiality requirement for not being disclosed, the whole process information such as the allocation, implementation and project implementation results of support funds for investment promotion shall be disclosed to the public and subject to social supervision in accordance with the principle of "whoever formulates shall allocate; whoever uses it shall be disclosed to the public". The disclosure is as follows:

        (a) Measures for the administration of funds and detailed rules for their implementation.

        (b) Guidelines for fund application, including application conditions, scope of support, object of support, examination and approval department, operating department, operator, telephone number for inquiry, etc.

        (c) The information of application for project funds, including the applicant, the application project, the application amount, etc.

        (d) Procedures and methods for the allocation of funds, including the contents and time requirements for the examination and approval of the allocation of funds, methods for the allocation of funds, methods for examination and approval, etc.

        (e) The results of fund allocation, including the detailed items of fund allocation and respective amounts, the organizations or enterprises to which the projects belong, etc.

        (f) Use of funds.

        (g) Capital performance evaluation, supervision, inspection and audit results, including performance evaluation reports, financial supervision and inspection reports, audit results announcement, etc.

        (h) Openly accept and deal with complaints, including the matters and reasons of complaints, dealing with complaints, etc.

        (i) Other contents that should be disclosed according to regulations.

        The above informationshall be published on the portal website of Zengcheng District People's Government. Information such as fund management measures and detailed implementation rules, application guidelines and distribution results shall be made public within 7 days after examination and approval.

        Article 23 Establish a performance evaluation system for support funds for investment promotion. The leading department for specific support items of funds shall, in accordance with the provisions of performance evaluation management, organize performance evaluation on the use of funds for each specific support item, and copy the results of performance evaluation to the District Bureau of Science and Technology, Industry, Commerce and Information. The subject of the project implementation shall carry out performance self-evaluation as required, and cooperate with the District Bureau of Finance to carry out other forms of evaluation; The District Bureau of Finance shall carry out performance evaluation on the use of funds as required.

        Article 24 The leading department for specific fund support matters shall organize its own department to carry out self-examination on fund management, conduct spot checks on the use of funds by the subject of project implementation and make records of spot checks, and report the results to the District Bureau of Science and Technology, Industry, Commerce and Information for the record. The District Bureau of Finance carries out daily monitoring of funds, while the District Bureau of Audit carries out audit supervision on the management, allocation and use of funds.

        Thesubject of the project implementation should consciously accept the supervision and inspection of the District Bureau of Finance, Science, Industry, Commerce and Information Technology, Education, Civil affairs, Agriculture, Culture, Tourism, Health, Audit and other departments and the relevant departments of the development zone.

        Article 25 Thesubject of project implementation shall, in accordance with the Archives Law of the People's Republic of China, the Accounting Law of the People's Republic of China and other provisions, file and keep the project application, implementation, acceptance and other data for verification.

        Article 26The implementation of fund management accountability mechanism:

        (a) For the relevant responsible persons of competent departments, such as the District Bureau of Science and Technology, Industry, Commerce and Information, Education, Civil Affairs, Agriculture, Culture, Tourism, Health, Finance, and the relevant departments of development zone, as well as other departments, intermediary agencies and evaluation experts, if there are violations of law and discipline in the process of fund allocation and approval, they will be punished in accordance with the relevant laws and regulations.

        (b) For the project implementation subject with an agreement signed with the district government, district government departments, town and street governments, if the project implementation subject fails to fulfill its commitments as agreed in the agreement, it shall not apply support funds for investment promotion. If it has already applied for and got paid, the leading department for specific fund support matters shall recover the paid funds in cooperation with the District Bureau of Finance, and the unpaid funds shall not be paid any more.

        (c) If the applicant organizations and enterprises apply, manage and use the funds in violation of laws and regulations, they will be punished in accordance with the relevant laws and regulations by recovering financial funds, canceling their qualification for fund application for 5 years and disclosing their non credit information to the public, at the same time reporting to the municipal public credit management system.

        Chapter V Supplementary Provisions

        Article 27 The provisions on "no illegal acts" and "good credit" in the relevant detailed rules of these Measures shall be implemented in accordance with Article 12(b) of these Measures. In case of any discrepancy between the relevant detailed rules and these Measures, the latter shall prevail.

        Article 28 These Measures shall be implemented as of the date of promulgation and shall be valid for 5 years. Upon expiration of the validity period or changes in relevant legal and policy basis, they shall be evaluated and revised according to the implementation.
